Suing the defendant in EU country – basic question: rules of jurisdiction.

Council Regulation (Ec) 44/2001 of 22 Dec. 2000 on jurisdiciton and the recognition and enforcement of judgment in civil and commercia matters.  

 As it's known, the basic principle to determine the court where the plaintiff can sue someone is the following: “jurisdiction is to be execised by the EU country in which the defendant have its own domiciled” regardless his/her nationality to be sued in his country.

   Reglamento (CE) n° 44/2001 del Consejo, 22 de diciembre del 2000, relativo a la competencia judicial, el reconocimiento y la ejecución de resoluciones judiciales en materia civil y mercantil.

El reglamento determina la competencia judicial en materia civil y mercantil. Estipula que las resoluciones adoptadas en un Estado miembro de la Unión Europea (UE) serán reconocidas en los restantes Estados miembros sin recurrir a ningún procedimiento, salvo en caso de oposición. 

Giuridsdizione, riconoscimento ed esecuzione di un giudizio straniero in materia civile e commerciale.

   Regolamento (CE) n. 44/2001 del Consiglio del 22 dicembre 2000 concernente la competenza giurisdizionale, il riconoscimento e l'esecuzione delle decisioni in materia civile e commerciale.

   La normativa Europea, con il regolamento innanzi indicato, disciplina la procedura di riconoscimento ed esecuzione delle sentenze emesse in materia civile e commerciale dalle Corti Europee. Viene così garantita la possibilità di poter dare maggior tutela e garantire i diritti di quanti promuovono una azione in un altro stato Europeo (secondo quelle che sono le regole sulla giurisdizione) e, successivamente, dovranno dare esecutività a quanto statuito dal Giudice del paese individuato precedentemente.

The European regulations, set rules regarding the jurisdiction of Courts in civil and commercial affairs. The award given in an European Country can be used in local (european) jurisdictions without particular procedures, unless the recognition is contested.
